Welcome to ZIIVENA. These Terms of Service ("Terms") govern your access to and use of ziivena.com (the "Site") and your purchase of products from ZIIVENA LLC ("ZIIVENA," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from the Site. By placing an order, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Products and Pricing
We make every effort to display our products, descriptions, and prices accurately. Product images are for illustration only; actual colors, packaging, and appearance may vary. All prices are listed in U.S. dollars (USD) and are subject to change without notice. We reserve the right to correct any errors, inaccuracies, or omissions and to update information at any time without prior notice.

3. Orders and Acceptance
Your order is an offer to purchase. We reserve the right to accept or decline any order, to limit order quantities, and to cancel an order at any time — including after an order confirmation has been sent — for reasons such as product availability, suspected fraud, or errors in pricing or product information. If we cancel a paid order, we will issue a full refund.

4. Payment
Payment is processed at checkout through our payment providers. By submitting payment information, you represent that you are authorized to use the payment method provided. Refunds are issued to the original payment method.

5. Shipping and Delivery
We currently ship within the United States with free standard U.S. shipping, and may accept select international orders. Shipping timelines, costs, and responsibilities — including any duties or taxes on international orders — are described in our Shipping Policy, which is incorporated into these Terms by reference.

6. Returns and Refunds
Because our products are consumable food items, returns and refunds are handled as described in our Refund & Returns Policy, which is incorporated into these Terms by reference. Please review it before purchasing.

7. Food Products, Allergens, and Health
ZIIVENA products are foods and beverages intended for enjoyment. They are not medicine and are not intended to diagnose, treat, cure, or prevent any disease.
- Allergens and ingredients: Please read the product label and ingredient information before consuming. Our products may be produced in facilities that also handle allergens. If you have a food allergy or medical condition, are pregnant or nursing, or are taking medication, consult your physician before consuming.
- Caffeine: Some products, such as our teas and yerba mate blends, contain naturally occurring caffeine and should be enjoyed in moderation. Our fruit and rooibos blends are caffeine-free.
- You are responsible for using and storing our products according to the instructions provided.

8. Intellectual Property
The Site and all of its content — including the ZIIVENA name, logo, trademarks, text, graphics, photographs, product and packaging designs, and overall look and feel — are owned by ZIIVENA LLC or its licensors and are protected by intellectual-property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

9. Acceptable Use
You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to infringe the rights of others, or to attempt to gain unauthorized access to any part of the Site or its systems. We may suspend or terminate access for any violation of these Terms.

10. Third-Party Links
The Site may contain links to third-party websites or services that we do not control. We are not responsible for their content, policies, or practices, and we encourage you to review their terms before using them.

11. Disclaimer of Warranties
The Site and our products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement — except for any warranties or rights that cannot be excluded under applicable law, including your statutory consumer rights.

12. Limitation of Liability
To the fullest extent permitted by law, ZIIVENA LLC and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Nothing in these Terms limits any liability that cannot be limited under applicable law.

13. Indemnification
You agree to indemnify and hold harmless ZIIVENA LLC and its owners, employees, and affiliates from any claims, damages, or expenses arising out of your violation of these Terms or your misuse of the Site or our products.

14. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-law rules. Any dispute relating to these Terms or your purchase will be subject to the exclusive jurisdiction of the state and federal courts located in Massachusetts, unless otherwise required by applicable consumer-protection law.

15. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date reflects the most recent version. Changes take effect when posted, and your continued use of the Site or placing of new orders constitutes acceptance of the updated Terms.

16. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Shipping Policy, Refund & Returns Policy, and Privacy Policy, constitute the entire agreement between you and ZIIVENA LLC regarding your use of the Site.
